Short answer: Yes. Forex trading is legal in South Africa. Brokers and anyone giving advice must be authorised by the Financial Sector Conduct Authority (FSCA), and CFD providers must also be licensed as over-the-counter derivative providers (ODPs). Using an unregulated offshore broker is risky and gives you little protection.

Who regulates forex in South Africa?

  • FSCA: licenses financial services providers (FSPs) under the FAIS Act, and OTC derivative providers under the Financial Markets Act. It publishes warnings about unauthorised firms.
  • SARB Financial Surveillance Department: exchange control, including how much money individuals can send offshore (the R1 million single discretionary allowance and the foreign investment allowance).
  • SARS: taxes your trading profits (see forex tax in SA).

How to check a forex broker

  1. Find the broker's FSP number (usually in the website footer).
  2. Search it on the FSCA's online FSP register and confirm the name, licence categories and status match.
  3. For CFDs, check it is an authorised ODP or an FSP acting as an intermediary for one.
  4. Check the FSCA's warnings and press releases for the company's name.
  5. Confirm client money is kept in segregated accounts.

Red flags of forex scams

  • Guaranteed or "fixed" monthly returns.
  • Pressure to recruit friends and family (pyramid or Ponzi structure).
  • Requests to pay a person, not a regulated company's bank account.
  • "Account managers" who want your MT4/MT5 password to trade for you.
  • Withdrawal fees or "taxes" you must pay before you can withdraw.
  • Lavish lifestyle marketing on social media instead of clear disclosures.

If you suspect a scam, report it to the FSCA and the SAPS. Don't send more money to "recover" losses: recovery scams target previous victims.
